bank fraud

my daughter has been arrested and waitng on a court date her court appointed lawyer said she was going to prison never looked over the case, i believe she has a total of 3 are 4 felonies the checks she received from her husband he was paying childsupport and now all that time is bank account was close, and he had to know thishe needs to be chargedmy question is can she get off witha probation and can she get her another court appointed lawyer and will this also make her court date change to a later date. thanks

Let me get this straight. Your daughter received child support checks written on a closed account? She is charged with theft because she took the money. I think the writer of the checks should also be charged, or at least sued for the money. However, it seems to me that this type of case should not go to trial or result in prison, unless there is more to it than you state. I am guessing the prosecutors think she knew the checks were written on a closed account and may have even given some of the money to her husband. If I misunderstood the situation, please re-write it.
