Legal Question in Criminal Law in Louisiana

purchase

I bought something from someone online and I sent them a cashiers check,it was on an auction but I just contacted the seller through e-mail instead of bidding and sent them this check.Can they cash this check and I not send the product and get away with it?

Dear LawGuru Friend,

I assume what you are asking is that if they don't send you the product you "purchased", but they cash or deposit your check and keep the money and don't send you what you bought, can they (the seller) get away with it. Of course, for them to do so would not be legal, but whether or not they would ultimately "get away" with it would depend a lot on where they may be, how adamant you might be about seeking to have them prosecuted, and just how much the government authorities, such as the local, state and federal police and law-enforcement personnel, might be willing to get involved to assist you in recovering your money or prosecuting the "seller" who would have bilked you of your money. The odds are that the seller will go ahead and ship to you the item or items you purchased and sent the payment for. This is just my immediate reaction to your question. I hope the seller ships to you the item or items you purchased, and you can put all of this uncertainty behind you. Good luck!
