Divorce

Whats the best way for me to go about obtaining a divorce... there is a child involved... do not know where the father is resides except that he lives somewhere in Tx.

We been physically separated for over 6 years... he makes no attempts to see our child. I just need to get this marriage out of the way

If you truly cannot find your husband, you can have an attorney appointed to represent him. That attorney then attempts to find your husband, and if he can, serves your husband with the divorce paperwork. If he cannot find your husband after a diligent search, you will be allowed to proceed with a divorce.

You can file divorce based upon living seperate and apart for 1 year. The court can appoint an attorney to represent the absentee husband and father who would be served with the papers. You may also request the court to terminate his parental rights if he has not supported the child or contacted/visited the child for extended period of time.
