My husband is salary and is working at a contraction site at the request of company and is working 70 hrs a week and being charged to a time sheet and the company don't want to pay him the 39 hrs overtime

Just because your husband works more than 70 hours a week doesn't mean he is entitled to overtime. It depends on what work he is doing. To determine whether he is entitled to overtime, I would need to know exactly what he is doing and how much he is paid in salary.
