If you don't have a written lease, you are on a verbal month-to-month lease. That means that the landlord can refuse to renew your month-to-month lease by giving you 10 days' notice before the end of the month that she will not renew. She can't kick you out during the month for which you have already paid rent (as you have already paid rent for that month), unless you did something to violate the law or the lease, like damage her property. If she didn't give you 10 days' notice, she has to let you stay for another month. However, your problem is going to be one of proof. Who was the real "tenant", you or your boyfriend? Who contracted with the landlord? Who has the right to stay and who could be kicked out? Tough questions to answer without a written lease. Next time, don't move in without a lease.
