My girlfriend is 18 years of age and my parents are afraid that if she rides with me and I get in a accident, her parents would sue mine, would she be of age to decide wether to sue or not?

18 years old is the age of majority in Louisiana. Her parents have no legal right to file anything in her name once she has reached the age of 18, so they can't sue you or your parents. Nevertheless, if your parents own the car you are driving, they could be liable as the owners of the car if you get into an accident. That would include a survival action if, God forbid, you are involved in a fatal accident. In such event, the parents would then have the right to sue as the legal heirs of their deceased daughter. |
