Legal Question in Real Estate Law in Louisiana

cosigning for real estate (mobile home)

Is there any way to evict a person from property that you have cosigned with them, after they have not been making payments. My dad cosigned a note for a mobile home with someone, she is not making payments, refuses to leave the premises, or sell the property. what can he do? It is getting near foreclosure, and I do not want his credit ruined. Can he evict her or force her to sell the property

Re: cosigning for real estate (mobile home)

Assuming there is no agreement not to partition, he can file suit to force a partition of the property.

However, the foreclosure will likely occur before the partition sale.
