Is my daughter responsible for these debts

My husband recently died he had no will. We have a 1 yr old child. He was paying on a Department of Labor debt and a loan all which occured before we were married. Is my child responsible for this debt because she is his heir? These debts occured before she was even born.

Yes she would be, as any other heir who accepts the succession. If the succession is insolvent, the heirs should renounce the succession and then they would not be liable for any of the debts of the succession. You should consult an attorney with all the specifics of the succession before making any decision.

Whether or not your daughter owes is your decision.

Consult a lawyer and have the succession evaluated. If it is insolvent, renounce it on your daughter's behalf.
