The answer as to what the penalty is for theft by deception is dependent on several factors. These factors include exactly what the item was, its value, and whether you have any prior history for substantially similar conduct. The controlling statute can be found here: http://www.mainelegislature.org/legis/statutes/17-a/title17-Asec354.html

Whether or not you need an attorney is only a decision you can make. A few factors to consider, although not an inclusive list, are whether you actually committed the crime, if this type of charge will affect your current or future employment (be reportable on applications, etc), your ability to negotiate with the DA's office, etc.
