My brother got a septic infection from dirty medical equipment used to perform a prostate biopsy,

does he have any legal recourse?

You ask a question that requires a very long and involved answer, as does any question about liability/fault in a medical malpractice case like this. The short answer is that it depends. Medical negligence must be shown. While it may appear obvious that someone is at fault, that is not always the case after a thorough investigation and after obtaining expert medical opinion(s). Also, regardless of an action to get money to compensate your brother for damages, you can file a grievance with the medical licensing board in charge of the type of practitioner that you believe caused the infection. You will have to call the Department of Professional and Financial Regulation and ask for the appropriate board, or you could go on the State of Maine government web site and find it.
