Legal Question in Real Estate Law in Maine

Landlocked land in Maine

I have been given a piece of property that is currently landlocked. The parcel is included in a development that has not yet been developed. I have viewed the tax map and the road is supposed to go around all the properties and meet on the other side.

I am wondering what my right are requiring the owner of the development to make a road so I can access the land and build a house?

Thanks for your input!

Peace, Julie

Re: Landlocked land in Maine

I would need to see the deed, but I am guessing that you have an easement in common with others to use a right of way to access the lot. The right of way should have been built by the developer before the deed was conveyed. The planning board probably requires that the road be built within a certain time as a condition of its approval. The town may therefore want to enforce its rules regarding the road.

I would need more information before answering how to best compel that the road be built, but you likely can also sue the developer to do so.
