What is the statue of limitations for the state to file

misdemeanor theft charges in Maryland

If the misdemeanor is punishable by a fine only,

and there are several types, the time period for

the State to initiate prosecution is 1 year from the

date of the offense. If the misdemeanor is punishable

by imprisonment, according to the statute which relates

to the charge, then there is no limitations period for

the State to file charges. The speedy trial right

begins at the point the State actually files charges,

not before, in general. There are other remedies, not

always as successful, if the State has waited too long

to file charges. More information is needed before a

more specific answer can be offered.
