Legal Question in Business Law in Maryland

Non competition

Is a 30 mile radius in a non competition enforcable by what is called air miles or ground miles? It does not specify in the agreement so I don't know which one it is. If it is air miles what is this?

That's an interesting question--one I've not come across before. Generally speaking, we're talking direct distance from the protected business--it would be too complicated to consider all the various roads that may lead to the business. If the "restricted" person sets up shop at least 30 miles away from the protected business, he should be okay.

The general rule in Maryland is that noncompetition geographic area restrictions are measured in ground miles. Noncompete provisions need to be carefully interpreted and complied with, especially when a new or related business is being started by the person or persons subject to the noncompetition provision of an employment agreement, partnership agreement, etc. An experienced business law attorney should be able to help you/your family with this in MD.
