Wage Garnishment

My husband's paycheck has been garnished. This was for a car respossession for a total of $16,000. He makes $13 an hour and obviously this will take a lifetime to pay. In the meantime, we can't pay our bills because so much of his small paycheck is gone. We want to pay this bill and wonder what our options are at this point. Can we go back into court and set up a payment plan or is our only option that he quit his job or declare bankruptcy. We can't afford that either at about $1500 and don't really want to do this as this is our only big debt. He has been sick the last few years and unable to do the job he normallly does because of neurological problems and has been in and out of work. That's why we couldn't afford to make the car payment in the first place.

If they won't settle, bankruptcy may be your only option. It may be possible to do this without an up-front payment, particularly if you do a chapter 13 (the total fee may be a little more, but not up front, and it would stop the garnishment sooner).
