Legal Question in Family Law in Maryland

In May of 2013, my child will be 18 years old. I understand that I need to file a motion to terminate my child support payments. My question is - Do I go to child support court and file the motion? When do I go? A couple of weeks before her birthday or after her birthday?

If your daughter is graduating from high school this spring, your support obligation will terminate upon her graduation. If she has another year or part year to go, your obligation will continue until she finishes or turns 19, whichever occurs first. I suggest you file the motion as soon as possible, so that the court has time to rule on it and it goes into effect in time, as explained above. You should indicate the termination date (which would be the first day of the month following emancipation) in the court order.
