Legal Question in Family Law in Maryland

Child Custody question:

I've been raising my daughter on my own since birth and she's 12 years old now, her father has been in and out of jail (eventhough the times he was out when she was really young he was kind of apart of her life), he's in jail now again (Virginia) and has been in there since she was 3 years old. The thing is I might get a job transfer to another state (Florida) and he's opposed of it, would it be illegal for me to take her out of state without his consent? I'm not sure if I have the right to do so. And how much of his opinion counts since he hasn't really been there?

In the absence of a custody order, there is no restriction on moving out of state with the child without the father's consent.
