Medical and DayCare Costs

My fiance has joint custody of his five year old son, with primary custody to his ex-wife. He pays $240 a month to his ex-wife for child support (they agreed on this amount together) and also provides medical, life, and dential insurance for his son. His he resonsible for paying for half of the daycare costs which she has recental enrolled him in and how do out of pocket medical costs work? (Co-pays; things not covered) Do they split them 50/50?

If there is a court order concerning child support, that order will tell your fiance what his responsibilities are. Sometimes the court might order support different from the statutory requirements. Usually, however, the order is based on the statutory child support guidelines, which require that the parent paying child support pay one half of uninsured medical expenses for any major illness or incident for which the bills exceed $100.00. Regarding the day care, if it is work-related, the cost is divided in the same way as the basic child support, pro-rated based on each party's percentage of the total combined income. If your fiance earns $2000 per month and the child's mother earns $1000 (combined $3000), he would be required to pay 2/3 of the day care cost. If he has a child support order which doesn't include the day care, he will not be required to pay it until the mother files a request for in increase and the increase is ordered by the court.
