If I have already signed a spousal consent and beneficiary waiver to my husband's retirement plan, does this mean it is no longer marital property? I haven't signed a separation agreement yet.

The future interest has been waived, not the present interest. Whether the retirement plan is or is not marital property requires another analysis. This focuses on dates of acquisition, how it was purchased and other factors.
