How can I file a civil suit ? I have an employer who has not paid me

An employee has a couple of options in unpaid wage situations. These types of cases can either be handled through government action OR by private suit. Filing suit may entitle the employee to up to three times the improperly withheld wages. Civil litigation must be started within certain time limits, generally within three years. All civil cases start with filing a formal Complaint in the appropriate court.

While in most types of cases the plaintiff pays for their attorney fees even if they win, in this area of law the employer is obligated to pay BOTH sides' attorney fees if the employee wins. You are encouraged to talk with an attorney who can evaluate your case.
