Legal Question in Immigration Law in Maryland

Permanent Resident Card Renewal with DUI conviction

I have been a permanent resident green card holder since February of 2000, and is about to expire in one year. It really concerns me about the renewal because I have been arrested two times for driving under influence of alcohol. The first arrest happened on 07 and unfortunatly a second in the end of 08, without being on probation. For the second case I have been charged with a DWI and a three year probation. Would I be able to renew my green card having these two convictions and being on probation? Or would it be possible for me to apply for the U.S. citizenship? I am only seeing joining the military as my only option to stay in the country right now. Please provide me help and suggestions. Thank you.

Re: Permanent Resident Card Renewal with DUI conviction

I am going to presume that you are a young man who has foolishly driven under the influence, but for all intent and purpose will never do it again -- right? Okay, one of the requirements for citizenship is that you be a person of good moral character for at least 5 years prior and up to your application. Now, although DWI's are not necessarily an indication of bad moral character, the fact that you have been convicted twice of the same offense may lead an officer to believe that you are a habitual offender - or at least offended twice; for some officers that is enough to make you wait another five years after your last episode which would make you eligible in 2013. Now, joining the military is not your only option -- you can simply renew your lawful permanent residence. Provided you are honest and truthful, your convictions do not appear (at this moment) to be anything than misdemeanors, yes? I suggest you renew your card and see what happens -- you will probably get your new card. Let me know what you decide to do -- I would be interested. By the way, you should get a good consultation from an attorney to confirm that there is a good possibiity to renew your card and also future interview date for naturalization. Good luck
