Legal Question in Medical Malpractice in Maryland

cosmetic surgery dissatisfaction

If cosmetic surgery results (liposuction) has been performed and the results are less than satisfactory and need to be redone what rights do I have as a patient, and consumer, of a service. Attempts to reconcile the situation with the original surgeon have been unsuccessful and I have sought a second opinion. The second opinion agreed that i needed the surgery redone and that it could be fixed. What steps, if any, can I take from here.

Re: cosmetic surgery dissatisfaction

Doctors do not guarantee results. Rather, they are simply obligated to perform the surgery in accordance with an appropriate standard of professional care. Unless you can show that the doc did something wrong, rather than just that it came out wrong, you have no recourse. Even then, it is unlikely to be worth pursuing unless you suffered serious injury as a result of the departure from the standard of care.
