Breaking Apartment Lease Due to Bad Health

My father is 75 years old and needs to move with me (his daughter) due to bad health and not being able to care for himself. He rented an apartment on June 15, 2000 and will expire a year later June 15, 2001.

What legal rights does he have to break the lease on or around December 15,2000 and not have to pay the remaining six months rent?

Your father cannot break his lease because of poor health. However, he may be able to find a replacement tenant (sub-tenant) if the lease permits it. He would remain responsible for the rent to the landlord, but if he finds the right tenant that shouldn't be a problem.

The other possibility is to offer a "lease-break"

fee to the landlord--maybe 1-2 months rent. If the property is in reasonably high demand, the landlord should be able to relet it without a significant gap in the rent stream.
