Am I able to sue the Real Estate agent that was to sell my house for siding with my x husband and delaying the sale resulting in loss of thousands of dollars?

You have a case if and given that both spouses signed for the contract of sale, each having legal interest on the deed, and that the terms of the contract of sale were not applied for a ready and willing buyer. Collusion with your estranged spouse need not be shown although this may bring a case against him, and possibly the agent, where the evidence exists. I assume neither spouse was represented through the separation and pending divorce and this alone is a matter for which you may want to seek counsel.

An experienced real estate attorney would need much more (and preferably all) of the facts of your case to deterimine whether or not: (1) you have a cause of action; and (2) what your chances of succeeding if you brought a cause of action. Some of the many facts he/she would want include: (1) Did the real estate agent represent you in the sale of a home you owned, or did he/she represent both of you? (2) Were you and your ex-husband represented by counsel in the transaction? (3) How and why was the sale delayed? (4) Was the agent and/or ex-husband justified in delaying the sale of the property?
