Legal Question in Sexual Harassment in Maryland

Is this sexual harassement, male to male

I was a contractor on a job and was wondering if this is sexual harassement. The home owner pulled his pants down in front of me and mooned me, then he had his 9 year old son do the same. His son has mooned me several times after that. On another occasion he made like he was going to shake my hand but rubbed it against his penis instead. Because of this the work enviroment suffered not knowing what was happening next. He was told on both occasions that it was not appreciated.

Same sex harassment is actionable. You should report this to your company and the general contractor. It is their responsibility to protect the workers on the job, including all contractors, from harassment.

If the job is over, you could file a claim, but it might not get very far if you did not report it and give the employer a chance to remedy the situation.

In any case, the place to file a complaint if you wish is either the EEOC or the human rights commission in the county where the job occurred. It is free to file, but you must do so before you can sue. There is also a time limit, so if you choose to file, do not delay.

If you wanted to go after the homeowner directly, you might have a case for sexual assault and battery and other torts, but it does not sound as if you have much in the way of actual damages. So it is probably not worth your time and money to pursue.
