Legal Question in Wills and Trusts in Maryland

estate laws

My mother passed away in 2002 and my brother and I are both executors of her Will. The Will states that I am to live in her house as long as I choose. She left me 55% of the home, one brother 30%, and one brother 12%. What happens to the other 3%? Also, what are my legal rights when it comes to when to sell, how much money to put into the house to fix it up, etc. The brother that is executor is supposed to be paying half of all property taxes, but I haven't asked for any $$$ since I've been living there. If he fixes the house up for sale, I'm afraid he'll try and get most of the money for doing this. Is there anyway to prevent this?

Re: estate laws

I have to read your mother's Last Will to answer that. You also don't mention whether the will was probated. Call if you would like to discuss.

Re: estate laws

From you question it appears that your brother would not be able to sell unless you agreed. As to carrying costs and maintenance, I cannot ascertain from what you asked. I need to see the actual language of the Last Will and Testament in order to answer your questions accurately. Fax me a copy, or scan and send in an e-mail and we can discuss.
