Legal Question in Wills and Trusts in Maryland

ring

My mom gave me her ring 1 yr. ago. She died in Oct,2006. The executor said the ring was mentioned in the will and I have to bring it back for appraisal. I said since I've had it 1 yr. in my possession & I live in Va., it is not in the estate and it does not need to be appraised. What is the law??? Thanks. Does the family have the right to see the will before it goes to probate court??? Thanks

If your mother actually gave you this ring, then it was a gift to you at that time and it cannot now be counted as part of your mother's estate--for any reasons or purposes--at all.

You should not turn it over without first demanding to see a valid copy of your mother's final will and testament which supposedly references this ring.

And, if further confusion should ensue, then make arrangements with a Virginia attorney who is knowledgeable with respect to wills and probate law to review the will and to advise you, accordingly.
