Legal Question in Bankruptcy in Massachusetts

I want to file bankruptcy on my unsecured debt. I have a personal loan thru OneMain Financial and they have the title to my car. But on my credit report, it states that the loan is unsecured. What can I do about this?

The credit report is probably wrong, which (unfortunately) is not all that uncommon. If the lender has possession of the title, then I think any court would consider them secured. You are right to be concerned, however, and this should be thoroughly investigated before filing a bankruptcy case.

Review your loan documents to determine if your loan is secured or ask the lender for a copy of the documents.
