Legal Question in Consumer Law in Massachusetts

failure to honor warranty etc. (automotive)

Dealer (Houser Hyundai) failed to post FTC required buyers guide on used vehicle I purchased.

Dealership refuses to make repaires to car under warranty.. (by cancelling appointments)

Dealer did make one repair but it was unauthorized.....

dealer made oral representations regarding the vehicle... that were not true...

what is a consumer to do?

Re: failure to honor warranty etc. (automotive)

1. Check with the Attorney General's consumer protection office to see if this dealer is or has been under investigation (also the county district attorney's office).

2. Call, email or write the regional or national Hyundai office (find it on the internet).

3. Send the dealer a letter, certified return receipt, under c 93A outlining your complaints and what you want them to do about it. They have 30 days to send a written response, after which you can take them to court, with double or treble damages and attorney's fees possible.

4. File a complaint with the FTC on their website (www.ftc.gov) or by mail.

5. Get in touch with one of the consumer problem solvers on a local or area newspaper or TV station.

6. Retain a lawyer to take care of it.

Retain an attorney to commence action under MGLA c. 93A the Consumer Protection Law which may entitle you to recover double or treble damages and your reasonable ATTORNEY'S FEES. Good Luck!
