Legal Question in Criminal Law in Massachusetts

My son entered his dorm room to find all of his belongings that were on his desk, gone. He contatced campus police. The items eventually reappeared. He was moved to another room. The following day he used his hand cream and felt a stinging sensation, then a burning sensation. He opened the bottle, it had been tampered with. A brown liquid was in the cream. Another student admitted to the tampering. There is no seriously bodily harm however, this is a crime isn't it?

It can be criminally prosecuted under either a poisoning statute or as an assault and battery by means of a dangerous weapon, to wit; chemical agent (the same as if randomly sprayed with chemical mace or pepper spray).

It can also be pursued in civil court as a battery and destruction of property.
