Legal Question in Family Law in Massachusetts

My ex-boyfriend is currently incarcerated for a Domestic Assault and Battery and. I have full custody of our 17 month old daughter. He is reusing to allow me to sell his Dirtbike and ATV in order to financially support our child. Also, he is threatening to have people come to the apartment to remove ALL furniture, except our daughter's, because they are in his name. The question I have is, can he legally do so even with Child Support in place?

Might I add, there is a modified Restraining Order against him. He can call and write me to have contact with his daughter. If he sends someone here on his behalf, is that still considered third party contact?

1 Answer from Attorneys

First, no one is entitled to self-help. If someone comes, tell them to show up with a court order stating they are entitled to take anything from the apartment. If they refuse to leave call the police.

Next, I would contact your attorney to get an order to protect your rights to furniture et cetera for the care of the child. If you do not have an attorney, call Boston legal services if you financially qualify for their assistance.

Good luck
