Gifts received while married

I am in the process of a divorce. I have been married for over 10 years. When my soon to be ex husband and I bought our townhouse (from his mother) she gifted us $37,500. Do I have to pay any of this back once we are divorced?

Property division is an art, not a science, and is based on many factors. It rarely is applied to individual properties; instead, we look at the marital estate as a whole. The gift from the mother, though substantial, is only one factor in determining allocation of debt and assets. You should discuss this with your current attorney; if you do not have an attorney, you should engage one.
