Absent a written agreement to the contrary, post-nuptual agreement, if your home becomes the marital home, it will become part of the marital assets and subject to division in the event of a divorce. He is not an owner, but may acquire some interest in the value of the home, at least to the extent it increases in value, post marriage as the marital home.

If you and your husband are concerned about it, you can enter in to an ante-nuptual agreement to determine what will be considered marital property and what is not.

Please feel free to contact me to discuss same.
