Legal Question in Family Law in Massachusetts

Massachusetts my ex-wife has had at times a live-in boyfriend with a history of physically abusing her ( police called twice). I just found out he has returned to her house after 5 days in a detox for heroin addiction. I have the children with me for weekend visitation. Can I keep our young children until an emergency court hearing can be scheduled regarding the safety of the children in her house?

You need to file an emergency Petition for temporary custody and contact children services. If you retain the children you could be at risk for her filing a complaint against you. If you get an emergency order for temporary custody that will protect you.
