Legal Question in Family Law in Massachusetts

if I get visitation not custody

If I get visitation, not custody of any sort, does that allow me to take my son on the weekends or during school vacation for overnights?

Re: if I get visitation not custody

Visitation orders are usually specific as to what visitation will be allowed. Overnight visitation is almost always usually allowed to fit parents. The child's age or particular emotional/behavioral concerns may be a factor in this decision. Parents with serious issues of fitness -- their own addictive or behavioral problems, or seriously inappropriate partners or living situations -- often do not get overnight visitation.
