Legal Question in Medical Leave in Massachusetts

FMLA & Wrongful Termination

I had FMLA to take care of my fiance for her medical condition. I had notes from all doctors they asked for and was approved. Her condition worsend and I had missed a couple weeks of work but was told that I was still covered under FMLA. I knew my employer wasn't happy that I was using my FMLA but they did'nt say anything directly to me about it. I was out another 2 days and returned to work upon which they fired me for an honest mistake I had made. The thing is the mistake is made by all those I work with, it's a very common mistake. I had been with the company 3 years. I am questioning if there is anything I can do since I feel I was terminated because I was using my FMLA and they did'nt like it?

Re: FMLA & Wrongful Termination

Why don't you send them a letter assailing your wrongufl termination and demand your immediate reinstatement to your former position.Advise them that if they fail to comply with your demand within five (5) days from receipt of your letter, you will initiate a procedings in appropriate forum to assail the wrongful termination.
