Re: elegelsation

Your friend's boyfriend needs to hire an attorney concentrating in immigration law. The answers are not to be found here, because the case will require significant professional time and attention. If your friend and her boyfriend have a strong enough and real bond, they will find a way to afford the attorney.

Re: elegelsation

If your friend is a U.S. citizen and her boyfriend came into the United States through a port of entry with a visa or was otherwise authorized to enter the United States, then he could apply for a green card (permanent residence) if he was otherwise admissible (e.g., no convictions for particular crimes, not a nazi, health reasons etc.). If he did not come into country with a visa, then he may not be able to adjust his status unless he satisfies certain conditions, like being "245(i)" eligible because a family member or an employer filed for boyfriend on or before April 30, 2001. The couple should consult an immigration attorney before getting married to see if they will be able to live together in the United States after the marriage.
