Legal Question in Immigration Law in Massachusetts

hello, i am and Indian married to US citizen who cheated me, refused to file the support form for immigration. Now can someone tell me If i am eligible for VAWA violence against women and children act law to come to US. I have never been to US and recently applied for the non immigrant visa which was refused,. does VAWA act applies only for those battered spouses who are currently in the US..i suffered great mental torture from my husband for the last 4 years who says he was just wasting my time and never intended to call me.

Hi. We've seen these cases before and have been successful with them. There is no legal requirement that you be physically present in the U.S. to file the matter. However, there will be many additional obstacles in proving your case. It's an uphill battle but one that can be won with appropriate documentation and USCIS viewing the case in the light most favorable to you.
