Legal Question in Immigration Law in Massachusetts

Marriage with a non-resident

I am getting married to my girlfriend tomorrow by the justice of the peace. She is here in america on a travel B1 visa. We made the decision a couple weeks ago and did not decide to get married until then. What forms do I need to fill out in order to change her visa to a resident visa? I have searched the web but have not been able to find any information. I know this is not an ideal case because of the visa type however we had no plans for marriage before she entered the country.

Thank you in advance

Re: Marriage with a non-resident

You will have to prepare a Petition for an Alien Relative and an Application for Adjustment of Status. You would also want to file such documents with an Application for an Advance Parole Travel Document and an Application for an Employment Authorization Document. In addition, you will need to prepare an Affidavit of Support. There are several other CIS documents that are required in the process. Our office would be pleased to assist with the preparation of such documents and in connection with the filing of same. Please feel free to contact us in New Jersey at 201-236-9998 or in New York at 212-430-6500.

Re: Marriage with a non-resident

Congratulations! You may apply for a spousal petition after the marriage with evidence of the marriage certificate; she may adjust her status to become a permanent resident and apply for work authorization is she wishes to work in the US.

You may contact me for a free consultation by email. Good luck!
