Legal Question in Employment Law in Massachusetts

from 2002 to 2009 I drove the company van back and fourth From Westboro, Ma to Salem, NH. I punched in the morning in Salem, NH and out at night in Westboro ,Ma. As an hourly person was this legal for the company to do?

First you have a statute of limitations problem for such a claim, it is more than 6 years ago. As to whether a real claim exists depends upon whether you were working from home or from your first appointment (I assume the van was taken home as a convenience to both you and the employer). If taking the van home was a convenience for you and the employer then you were probably overpaid. Basically, your claim is dependent when your job/work begins and ends.
