Legal Question in Employment Law in Massachusetts

Hello,

I hired an individual who is to begin employment with us next week. We agreed that contact with her current employer would not occur until she officially gave her notice. I contacted with her consent her current employer and learned that her rate of pay was not consistent with the rate she indicated she was currently receiving. The difference was remarkable and clearly has raised flags as to her character among other things. We hired her at the rate she stated she was earning.

I wish to withdraw our offer and indicate to her that the reason we have decided not to bring her on board was falsification of her application i.e. not being truthful about her current compensation.

I just want to be certain I am on safe ground.

You really need to discuss this in detail with an employment attorney. While, in all liklihood, you will prevail in any lawsuit, you want to prevent the lawsuit.
