Private facility charging holiday rates

My partner received an email from a manager of a symphony hall stating the date we want to have our event falls on Yom Kippur so he has to charge us holiday rates because he has to pay the workers holiday pay (I didn't realize all employees of Symphony Hall were Jewish). Can a private facility charge holiday rates for a holiday that is not a federally recognized one, or state for that matter?

A private facility can charge you whatever rates they like for almost any reason they like. "Oh, you'd like your function on a Tuesday? We charge a special 'Tuesday' markup." Of course, you're also free to tell them to take a hike.
