Legal Question in Landlord & Tenant Law in Massachusetts

awful roommate being evicted, can i do anything?

(its probably helpful to know that I'm a female in my mid 20's) : My roommate is being evicted after not paying rent for 5 months. He was served by the sheriffs dept last week. Our lease ended on April 30th 2009. Initially my roommate advertised himself (back in January of this year) as a social worker who was responsible, works daytime hours, loves his friendly dog and is clean. In reality, he is a bartender who comes in drunk at 3AM, eats my food, and is filthy. In addition, he served jail time for multiple DUI's in March. He brings random girls home all the time who use the bathroom (my bathroom), and they make all kinds of noise. Is there anything I can do? What would happen if I called the police? Any answers/advice would be greatly appreciated. I'm tired of feeling helpless in a bad situation for a great apartment I don't want to give up.

It sounds as though he is being evicted. Are you being evicted along with him? You should contact your landlord and see if s/he will renew your lease without him.

Assuming the eviction is handled properly, he should be out in a couple of months. In the meantime, you really can't call the police on him for living a lifestyle you find deplorable or failing to pick up after himself.
