Expired lease

My lease expired in Nov. of 07, my landlordhas threatened to serve us with a 30 day notce to quit if we have not moved by the time our baby is born in Oct. The reason is that the house has lead paint. We plan to move soon. We do not want to move twice. Do we have to meet her deadline? We are in the process of buying a house. We have never been late with rent,ever.

A notice to quit based on lead paint and a baby is illegal.

It is illegal for your landlord to evict you for having children. HE is trying to avoid having to incur the cost for deleading the home. His analysis is wrong.

Regardless you do not need the aggravation, if you can find a new place move. If not you have a defense to the move regardless.
