Legal Question in Landlord & Tenant Law in Massachusetts

Ok I have judgemebt against me in mass from a firmer landlord. I never re eived any notification to go to court prior to receivi g a capias warrant. I moved out due to my son (2yr old) lead level being elevated @6. Also the neighbor was verbally abusive to my children multiple times with us calling police. I dont feel that this is right and want to sue them..what should I do?

You have two separate issues, and you may not want to confuse them.

First, you need to deal with the judgment against you. If you never had notice of the suit, then you may have the right to file a motion to vacate the judgment. Hire a lawyer or go to the summary process clerk's office in the courthouse where your landlord obtained judgment and they may be able to provide you with a form. Be ready to provide a good reason why you failed to defend the lawsuit and why you may have a good defense to it worth reopening the case.

If your son showed lead paint poisoning, then you should speak with a lawyer as soon as possible.
