Legal Question in Landlord & Tenant Law in Massachusetts

My landlord hasn't cashed 2 of my rent checks. They have not offered me a new lease. Yearly has been lease time. I sent checks and asked last month if they would cash, he said he may have missed placed it. But now my second check has not been cashed. They have not sent any eviction notices or any type of communication. I will have the money in checking acct. Is he going to evict me? Do I have any recourse?

If you are that worried I suggest you stop payment and send him two replacement checks with a cover letter explaining why you cancelled the two checks. Send the letter with the checks certified mail return receipt or at least with proof of delivery.

I doubt he will evict you. If this is a first eviction in the last 12 months you can pay the rent and stop the eviction.

Otherwise call and ask him if he has the two checks and when is he going to deposit them?
