landlord won't return deposit

I was interested in the apt. so I gave the landlord a deposit. Section 8 inspector failed the insepction twice. I decided not to take the apt. after all. I never signed a contract. Now the landlord will not return my deposit. Can I sue him for treble the amount?

You can sue him and you can ask for treble damages, but they will not automatically grant them. Your demand for return of the deposit should be in writing, preferably sent by certified mail. I believe a Landlord is not permitted to hold a deposit if the unit fails Section 8 inspection and you are receiving Section 8 assistance.

I suggest you sue him in housing court, where you can get some assistance from volunteer attorneys.
