Legal Question in Medical Malpractice in Massachusetts

I have a clotting condition and after surgery was given an improper dosage of blood thinners that led me to form 3 blood clots. Can I pursue a case against the hospital for negligence?

You can pursue such a case. However, unfortunately, hospitals are subject to "charitable immunity," so you would likely have to pursue your case against the doctors, or nurses who prescribed the improper blood thinner - instead of the hospital. However, the charitable immunity cap is $20,000.00. So if your damages were less than that, you would probably want to make a claim against the hospital - since pursuing a medical malpractice claim requires jumping over a lot of hurdles.

Fortunately, most Massachusetts doctors carry insurance, so, if you were able to recover, there would be an insurance company available to provide you with a remedy.
