Legal Question in Medical Malpractice in Massachusetts

medical consent of release

My release specifically said only to release attendance, level of participation, not content and may fax urines only upon my request to DSS. The initial investigation was already completed by DSS. My provider left a message on my DSS workers voice mail that I had 2 dirty urines. I had not given permission for them to talk about my urines only that they be faxed only upon my request. Was there a violation of my patient confidentiality rights?

It depends on what the release says and what you agreed to with DSS. If you are involved in a Care and Protection you should consult with your attorney.
