Legal Question in Medical Malpractice in Massachusetts

Rhinoplasty nightmare

Last year I underwent a rhinoplasty with a surgeon recommended by a family friend. His initial exam was nothing more than poking around with q-tips and taking a few pics. After surgery he commented on how I had one of the worst deviated septums that he had ever seen and insisted it must have been broken as a child. After the swelling started to go down I began to notice a bump on my left nostril. I went back to the doc and he said it was just swelling. It was not swelling. It was my septum sticking out and obstructing my nostril by about 40%. I had a very hard time breathing after this, but I had to wait a year until all of the swelling went down to have it fixed. I just had it fixed by an ENT in NC, who could not figure out what the previous surgeon had done. He also fixed the large obvious bump that he left on the bridge of my nose. Does it sound like I have a case considering he obviously did not examine me thoroughly to see that I had a deviated septum and he proceeded with the surgery anyway?

Re: Rhinoplasty nightmare- Medical Malpractice / Personal Injury Law

That sounds like a difficult situation. In order to prevail in a medical malpractice lawsuit you must show that the medical doctor deviated from the proper standard of care and as a result of the doctor's negligence you suffered damages.

You should consult with a Massachusetts (MA) personal injury attorney. The lawyer will evaluate the case to determine whether you have a case worth proceeding with.

Re: Rhinoplasty nightmare

Hi -

Sorry to hear about your ordeal. In order to have a case, damages and liability must be established. You do have damages. The liability question can only be determined when it is establised that the doctor in question deviated from the "standard of care." I will be in the office Monday if you would like to talk this one out, in order for me to know more about your case. Thanks.

Chris
