Legal Question in Personal Injury in Massachusetts

I bought a car for $2,800 in November of 2010. In December of 2010, someone else drove my car and totaled it while I was not operating it or even in the vehicle at the time. That person since has not paid any money toward replacing the cost of the car, after they initially verbally agreed that they would make small payments. If I take this person to court, is it likely I would be able to get my money back for the car?

Is the person not making the money because he or she does not have the ability to pay? Or is he or she not making payments because he or she is simply reneging on the obligation? It can be time consuming and troubling to force someone to pay a small debt. Be sure the person has the ability to pay.
